TERM AND USE

1. Acceptance of Terms

By downloading, accessing, or using the FOCO mobile application (“App”), you agree to be bound by these Terms of Service (“Terms”).

If you do not agree to these Terms, you must not use the App.

2. Description of Service

FOCO is a productivity and focus application designed to help users:

  • Start tasks
  • Break down complex activities
  • Improve focus using AI-assisted tools

The App may include both free and paid features.

3. User Accounts

To access certain features, you may be required to create an account.

You agree to:

  • Provide accurate and complete information
  • Maintain the confidentiality of your account credentials
  • Be responsible for all activities under your account

4. Subscription Terms (FOCO Pro)

FOCO may offer auto-renewing subscriptions (“FOCO Pro”) that provide access to premium features.

4.1 Free Trial

  • Some subscriptions may include a free trial period
  • If not canceled before the trial ends, the subscription will automatically convert to a paid plan

4.2 Billing & Renewal

  • Payment will be charged to your Apple App Store or Google Play account
  • Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period
  • Your account will be charged for renewal within 24 hours prior to the end of the current period

4.3 Pricing

  • Prices are displayed in-app and may vary by region
  • All prices are subject to change where permitted by law

4.4 Cancellation

  • You can manage or cancel your subscription through your App Store or Google Play account settings
  • Deleting the app does not cancel your subscription

4.5 Refunds

  • Payments are processed by Apple or Google
  • Refunds are subject to their respective policies

5. AI Features & Limitations

FOCO includes AI-powered features designed to assist users in task initiation, structuring, and focus.

By using these features, you acknowledge and agree that:

  • AI-generated outputs are automatically produced and may be incomplete, inaccurate, or not suitable for your specific situation
  • The AI does not have full awareness of your personal circumstances
  • Outputs are provided for informational and productivity purposes only

You are solely responsible for:

  • Reviewing AI-generated suggestions
  • Deciding whether to act on them
  • Any outcomes resulting from their use

FOCO does not provide:

  • Medical advice
  • Psychological or mental health advice
  • Legal or professional advice

5.1 AI Data Processing

To provide AI functionality:

  • User inputs (such as tasks and messages) may be processed by secure third-party AI providers
  • Processing is limited strictly to delivering the requested functionality
  • FOCO does not use user content to train public AI models

6. Acceptable Use

You agree not to:

  • Use the App for unlawful purposes
  • Attempt to access systems without authorization
  • Interfere with or disrupt the App
  • Upload harmful, abusive, or illegal content

7. Intellectual Property

All rights, title, and interest in and to the App, including all content, design, and technology, are owned by FOCO or its licensors.

You may not:

  • Copy, modify, or distribute the App
  • Reverse engineer or attempt to extract source code

8. Termination

We reserve the right to suspend or terminate your access to the App if you violate these Terms.

You may stop using the App at any time.

9. Disclaimer of Warranties

The App is provided on an “as is” and “as available” basis.

We do not guarantee that:

  • The App will be uninterrupted or error-free
  • The App will meet your expectations
  • Any results obtained from the App will be accurate or reliable

10. Limitation of Liability

To the maximum extent permitted by law:

FOCO shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

  • Loss of data
  • Loss of productivity
  • Loss of profits

11. Privacy

Your use of the App is also governed by our Privacy Policy.

12. Your Rights (GDPR – EEA Users)

If you are located in the European Economic Area, you have the right to:

  • Access your personal data
  • Correct inaccurate data
  • Request deletion of your data
  • Restrict or object to processing
  • Request data portability

Subscriptions and Billing

Subscriptions purchased through the Apple App Store are governed by Apple’s billing policies and terms.
